Terms and conditions

General terms and conditions for the short-term rental of holiday homes

The use of Chalet Panor’Anna is subject to the following general terms and conditions and the attached house rules. (This translation is provided for information only; the German version is legally binding.)

  1. Scope

These general terms and conditions apply to all bookings for the rental of Chalet Panor’Anna as accommodation and to all related services and supplies provided by the landlord.

  1. Conclusion of contract (booking)

The booking of the holiday accommodation is concluded by the booking confirmation sent to the guest following the online booking. The booking is therefore legally binding upon receipt of the booking confirmation. By booking, the guest also accepts these terms and conditions and the house rules, which were made available to the guest in advance. The guest confirms that they are of legal age at the time the contract is concluded and are legally entitled to enter into this contract and to assume all obligations and rights arising from it.

  1. Stay

The guest must treat the chalet, its inventory and the facilities belonging to the house with care. The guest is responsible for cleaning the chalet during the rental period. When leaving, the guest must also make sure that the accommodation has been swept, the bed linen stripped, the windows closed, the lights switched off and the radiators turned down.

Use of the chalet is reserved for the guests specified at the time of booking. If the holiday accommodation is used by more people than agreed, a separate fee of 162 euros per person per day is payable for them. Subletting or making the holiday accommodation available to third parties is not permitted.

During the stay, the house rules made available to the guest apply. Pets are expressly not allowed, either inside or outside the chalet. In the event of a breach of the terms and conditions or the house rules, the landlord is entitled to terminate the rental immediately and without notice. There is no legal entitlement to a pro rata refund or compensation.

  1. Rental period

The short-term rental contract applies for the period specified in the booking confirmation. Arrival and departure times are set out in the house rules. Any extension of or change to the booked stay requires the landlord’s express written consent.

  1. Rental price and payment terms

5.1 The rental price includes the use of the chalet and the additional costs listed in the contract (e.g. final cleaning, bed linen, towels).
5.2 Unless otherwise agreed, the rental price is generally payable in full at the time of booking and before arrival.
5.3 The landlord reserves the right to request a deposit payment.
5.4 The landlord is entitled to ask the guest for the security deposit calculated in the booking confirmation. The security deposit serves as security for the fulfilment of the guest’s obligations under this contract. The landlord may use the security deposit to cover all claims arising from damage to the rental property, failure to comply with contractual obligations or outstanding payments. The landlord is entitled to retain all or part of the security deposit if damage or outstanding obligations are found.
If no damage to the rental property is found and all contractual obligations have been properly fulfilled, the landlord must refund the security deposit to the guest within 10 days of the end of the rental. Any deductions for damage or outstanding payments will be communicated to the tenant in writing and in detail.

  1. Withdrawal and cancellation

6.1 The guest may withdraw from the contract at any time. Withdrawal must be declared in writing.
6.2 In the event of withdrawal, the landlord is entitled to reasonable compensation:

    • up to 30 days before the start of the rental: 100% refund of the total rental price less booking and payment costs of 3%.
    • up to 7 days before the start of the rental: 50% refund of the total rental price less booking and payment costs of 3%.
    • less than 7 days before the start of the rental: no refund.
    • no refund after check-in.

6.3 The guest is free to prove that the landlord has suffered no loss or a significantly lower loss.
6.4 The landlord may cancel the booked service without giving reasons up to 7 days before arrival. Any payments already made will then be refunded to the guest in full. Later cancellation of the contract is also permitted in the event of force majeure or other unforeseeable circumstances that make the booked stay impossible. In this case, liability is limited to refunding the rental price. In the event of justified cancellation, the guest has no claim to compensation. Liability for travel and hotel costs is also excluded. We recommend taking out travel cancellation insurance.

  1. Liability

7.1 Within the scope of the duty of care, the landlord is liable for providing the rental property properly. Liability for any outages or disruptions to the water or electricity supply and for events and consequences of force majeure is excluded. The landlord also accepts no liability for the loss of items or theft in the house or on the property.
7.2 The guest is liable for damage caused wilfully or through gross negligence. In addition, a fee of 162 euros is payable if the keys to the chalet are lost.

  1. Return of the holiday home

At the end of the rental period, the guest must return the chalet in proper condition and swept clean. All keys must be handed over to the landlord. If keys are lost, the guest bears the cost of replacing the locks.

  1. Privacy policy

The landlord processes the guest’s personal data for specific purposes and in accordance with the statutory provisions. The data will not be passed on to third parties unless this is necessary for the performance of the contract.

  1. Severability clause

Should individual provisions of these terms and conditions be or become invalid or unenforceable after conclusion of the contract, the validity of the remainder of the contract shall not be affected.

  1. Applicable law and jurisdiction

Belgian law applies. The place of jurisdiction for all disputes arising from this contract is the landlord’s place of business.
